Terms of Service

1.  Acknowledgment and Acceptance of Terms

When you use this service, you indicate that you have read, understood, and agreed to accept all contents of these Terms of Service. Additionally, when you use specific services provided by MOTOR Design, you may be required to comply with additional terms of service or related regulations announced by MOTOR Design according to the nature of those specific services. These additional terms of service or related regulations (including but not limited to anti-spam policies) are also incorporated into and form part of these Terms of Service.
If you are under the age of twenty, in addition to complying with the above provisions, you should have your parent(s) or guardian(s) read, understand, and agree to all contents of these Terms of Service and any subsequent modifications or changes before you may use or continue to use this service. When you use or continue to use this service, it is presumed that your parent(s) or guardian(s) have read, understood, and agreed to accept all contents of these Terms of Service and any subsequent modifications or changes.


2. Your Registration Obligations

In order to use this service, you agree to the following:
(a) Provide accurate, current, and complete information about yourself as prompted by the registration form of this service. (b) Maintain and promptly update your personal information to ensure it is accurate, current, and complete. If you provide any inaccurate, false, or incomplete information, MOTOR Design reserves the right to suspend or terminate your account and refuse your use of all or part of this service.


3. Member Account, Password, and Security

After completing the registration process for this service, you are responsible for maintaining the confidentiality and security of your password and account. If your password or account is compromised or if there are any other security issues, you must immediately notify MOTOR Design. Additionally, you must log out of your account at the end of each session.


4. Protection of Children and Adolescents

Children and adolescents accessing the internet has become an unavoidable trend. Using the internet to gain knowledge can cultivate maturity and competitiveness in children. However, the internet contains inappropriate content for children and adolescents, such as pornography and violence, which can potentially cause mental and physical harm. To ensure the safety of children and adolescents using the internet and to protect their privacy, parents (or guardians) should fulfill the following obligations:
a. Review whether each website has a "Privacy Policy" to protect personal data before deciding whether to consent to providing related personal information. Continuously remind children and adolescents not to disclose any personal information (including names, addresses, phone numbers, email addresses, photos, credit card numbers, etc.) to anyone. They should also not agree to meet with anyone in person based solely on invitations or gifts from online acquaintances.
b. Carefully select appropriate websites for children and adolescents to browse. Children under the age of twelve should be supervised throughout their internet usage. For adolescents aged twelve or older but under eighteen, consider whether to provide consent before they go online.


5.  User's Legal Responsibilities and Commitments

You promise not to use the service for any illegal purposes or in any illegal manner, and agree to comply with all relevant laws of the Republic of China (Taiwan) and international practices concerning internet use. If you are a user outside the Republic of China, you agree to comply with the laws of your respective country or region. You further agree and guarantee not to engage in activities through the service that infringe upon the rights of others or are unlawful, including but not limited to:
A. Uploading, posting, publishing, or transmitting any defamatory, insulting, threatening, offensive, indecent, obscene, false, unlawful, or immoral text, images, or any form of files through the service.
B. Infringing upon the reputation, privacy rights, trade secrets, trademarks, copyrights, patents, other intellectual property rights, and other rights of others.
C. Violating confidentiality obligations under laws or contracts.
D. Impersonating others using the service.
E. Uploading, posting, transmitting, or distributing data containing computer viruses or any code that may disrupt, destroy, or limit the functionality of computer software or hardware.
F. Engaging in illegal transactions or posting false, misleading, or criminal messages.
G. Sending spam, junk mail, chain letters, illegal multilevel marketing messages, etc.
H. Harming minors in any way.
I. Falsifying message origins or interfering with the identification of transmission sources in any way.
J. Interfering with or disrupting the service, servers, or networks connected to the service, or failing to comply with the requirements, procedures, policies, or regulations for connecting to the service, including but not limited to using any device, software, or deliberate evasion of MOTOR Design's exclusion headers for automated search.
K. Tracking others or otherwise collecting or storing personal information about others without their consent.
L. Other behaviors deemed inappropriate by MOTOR Design for justifiable reasons.


6.   System interruption or malfunction

Sometimes there may be interruptions or malfunctions in this service, which may cause inconvenience, data loss, errors, unauthorized alteration, or other economic losses during your use. You should take protective measures when using this service. MOTOR Design shall not be liable for any damages caused to you due to the use (or inability to use) of this service, except in cases of intentional misconduct or gross negligence.


7.   Information or advice

MOTOR Design does not guarantee the accuracy or completeness of the information or advice obtained through your use of this service or from links to other websites provided by this service (including but not limited to business, investment, financial planning, medical, legal advice, etc.). MOTOR Design reserves the right to modify or delete information or advice provided by this service at any time. Before making any decisions or plans based on such information or advice, you should consult with a professional to obtain advice tailored to your specific needs.


8. Protection of Intellectual Property Rights

MOTOR Design's software or programs, all content on the website, including but not limited to product information, images, files, website structure, webpage design, member content, etc., are protected by intellectual property rights owned by MOTOR Design or other rights holders under the law, including but not limited to trademark rights, patent rights, copyrights, trade secrets, and proprietary technologies. No one may use, modify, reproduce, publicly broadcast, transmit, publicly perform, adapt, distribute, publish, publicly display, perform reverse engineering, decompile, or disassemble them without authorization. If you wish to quote or reproduce the aforementioned software, programs, or website content, except as expressly permitted by law, you must obtain prior written consent from MOTOR Design or other rights holders. Respecting intellectual property rights is your obligation, and any violation may result in liability for damages to MOTOR Design. MOTOR Design and its affiliated companies protect trademarks such as MOTOR Design trademarks related to marketing and promoting this service, including product or service names and designs, under trademark law and fair trade laws. Without prior written consent from MOTOR Design, you agree not to use MOTOR Design trademarks in any way.


9.  Notification

MOTOR Design may provide notifications to you through various means including but not limited to email, postal mail, SMS, MMS, text message, postings on the service website, or other reasonable methods as required by law or applicable regulations, including changes to these Terms of Service. If you access the service without authorization or violate these Terms of Service, you may not receive such notifications. By accessing the service in an authorized manner and agreeing to these Terms of Service, you consent to receive all notifications from MOTOR Design, which will be considered effective upon delivery.


10. Termination

You agree that MOTOR Design may, at its discretion and for any reason, including but not limited to prolonged periods of inactivity, court or governmental orders, inability to continue the service or substantial changes in service content, unforeseen technical or security issues or problems, fraudulent or illegal activities by you, failure to pay fees as agreed, or other violations of the terms of service, terminate or restrict your access to your account (or any part thereof) or the use of the service. MOTOR Design may also, at its sole discretion, terminate or restrict your use of the service or any part thereof with or without notice. You acknowledge and agree that upon such termination or restriction, MOTOR Design may immediately deactivate, delete, or limit access to your account and all related information and files in your account, and cease all or part of the service. Furthermore, you agree that MOTOR Design shall not be liable to you or any third party for any termination or restriction of access to the service.


11. General provisions

The terms of service constitute the entire agreement between you and MOTOR Design regarding your use of this service, replacing any prior agreements between you and MOTOR Design concerning the service. The interpretation, application, and disputes related to these terms shall be governed by the laws of the Republic of China (Taiwan), and the Taipei District Court shall have exclusive jurisdiction over any disputes arising from these terms, unless otherwise stipulated by law. Failure by MOTOR Design to exercise or enforce any rights or provisions of these terms shall not constitute a waiver of such rights or provisions. If any provision of these terms is found invalid by a court of competent jurisdiction, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the remaining provisions of these terms shall remain in full force and effect. The headings in these terms are for convenience only and have no legal or contractual effect. If you violate any of these terms, please contact MOTOR Design customer service immediately.
